Terms of use

These Terms of Use of the PawsHub.app (hereinafter: the "Terms of Use") govern access to and use of the PawsHub platform (hereinafter: the "Service"), owned and operated by VELJKO TEKELEROVIĆ PR IZRADA INFORMACIONIH SISTEMA VEXTECH BEOGRAD, with its registered seat at Grčića Milenka no. 1, Vračar, Beograd, registration number (MB): 67777581, tax identification number (PIB): 114689518 (hereinafter: "Vextech" or "We").

The Service comprises the "PawsHub.app" website (hereinafter: the "Website").

Use of the Service includes:

• online advertising for offering various pet and animals services or needs
• searching for various pets and animals services or needs

Accordingly, there are three categories of Service users:

• natural persons that advertise various services or needs on the Website related to the pets and animals,
• legal entities that advertise various services on the Website related to providing services for pets and animals,
• natural or legal entities that advertise various services on the Website for pets or animals adoption

All categories are hereinafter collectively referred to as "Users" or "You."

These Terms of Use constitute a contract of adhesion between Vextech, as the operator of the Service, on the one hand, and the User, on the other hand. Users are therefore requested to carefully read these Terms of Use prior to registration and use of the Service. Vextech enables Users to use the Service exclusively in compliance with all provisions set forth in these Terms of Use and grants them certain rights, while also imposing obligations necessary for the use of the Service. If, for any reason, a User does not agree with these Terms of Use, the User will not be able to use the Service. By accepting these Terms of Use, the User declares that they have read, understood, and accepted the Terms of Use, thereby establishing a contractual relationship between the User and Vextech.

Vextech reserves the right to unilaterally amend the Terms of Use at any time and for any reason, in accordance with the procedure described in these Terms of Use. In such a case, the User shall be required to accept the amended Terms of Use in the manner prescribed by these Terms of Use in order to be granted continued access to and use of the Service.

In order to use the Service, you are required to meet the following requirements:

• you must truthfully complete the mandatory fields in the registration form in which personal data are requested, or register by using the services and products of third parties;
• you must agree to the Terms of Use;
• you must agree to the Personal Data Processing Notice; and
• you must agree to any additional general acts relating to the Service, if applicable.

After accessing the Website within the "users" details, you are required to select the option relating to registration and create a user account on the Website.

When creating a user account, you are required to enter the following data:

• First and last name,
• Email address

Service may create a user account by using the services and products of third parties (e.g. Google, LinkedIn, and similar). Upon entering all required data and accepting the Terms of Use, the Personal Data Processing Notice, and any other applicable general acts, the User account shall be deemed activated.

In order to be able to use the Service in the capacity of a User, it is first necessary that you have a device with enabled internet access. One person/entity (User) may have only one user account.

The User guarantees that all data relating to their identity provided to Vextech are accurate, precise, and complete. In addition, the User undertakes to update such data in the event of any changes.

If the User provides inaccurate, imprecise, or incomplete data, or if Vextech considers that there are reasonable grounds to doubt the truthfulness or accuracy of such data, Vextech may deny the User current or future access to the user account, the Website, and the Service as a whole.

The User undertakes not to disclose their user account data nor to allow third parties access to their user account. The User is solely responsible for any use of such data or services by third parties.

Vextech is obliged to block a user account if the User duly notifies Vextech that there is a suspicion that an unauthorized person is using the user account, and to restore the account once it has been notified that such suspicions no longer exist.

After registering in the capacity of a User, the User may access and edit their personal profile. The purpose of the personal profile is to provide as much relevant information about the User as possible. When editing the personal profile, the User may enter personal data, contact photo, contact details, external links, and other data.

Through the designated field on the Website, the User may access the search of available advertisements. When searching advertisement, the User may use filters including location, service category or text of the advertisiement.

When creating new advertisiement, User is required to enter advertisement details such as:

• advertisement category
• advertisement text
• contact details
• location data

Additionally, when creating new advertisement, User may optionally provide following details:

• advertisement images
• price information

The posting of content on the Service shall in no way restrict the User from posting or publicly communicating the same content elsewhere.

The User may, at any time and without providing any explanation or notice, request the deletion or modification of content previously posted. Upon receipt of such request, Vextech shall delete or modify the content without delay.

By posting content on the Service, the User unconditionally and irrevocably authorizes Vextech to transmit such content to an indefinite number of persons.

In the event that a User has been charged a fee for services that were not performed in accordance with these Terms of Use, the User is entitled to submit a complaint via email to the following email address: sales@vextech.io.

Vextech shall process all complaints within the shortest possible timeframes.

User Obligations:

• Each User is obliged to use the Service in accordance with these Terms of Use.
• The User undertakes to ensure that the use of the Service complies with applicable laws and regulations; does not infringe intellectual property rights or other proprietary rights of any third party; and is not offensive, illegal, inappropriate, or in violation of these Terms of Use.
• In the event of a breach of the obligations set forth in this Article, the User shall be obliged to indemnify Vextech for all losses, liabilities, and costs incurred. Vextech has the right to investigate any reported violations and may take any legal or factual actions it deems appropriate.
• Appropriate measures may include removing content, temporary suspension of the user account, permanent deactivation, and initiation of legal proceedings.

The User may, at any time, terminate the established relationship between Vextech and the User by permanently deactivating their user account by submitting a deactivation request via the Website.

Vextech reserves the right to deny a User access to the Service at any time, with immediate or permanent effect, by temporary suspension or permanent deactivation of the user account, in the event of a breach of User obligations or in other cases prescribed by law or by these Terms of Use.

Care for personal data and transparency in operations are key values on which Vextech bases its business activities. All necessary information regarding the use of Users' personal data for the purposes of the functioning of the Service can be found in the Personal Data Processing Notice.

Vextech is the entity that owns and operates the Service. The Service does not constitute a substitute for professional consulting services or employment mediation. Vextech does not participate in any manner in the recruitment process or in the conclusion of any type of contract between an Employer and a Candidate.

The User agrees to use the Service at their own risk. Vextech shall take all reasonable steps to provide the User with an appropriate level of service; however, it does not guarantee that such services will be free from defects or interruptions at any time.

Vextech shall not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect the User's equipment as a result of using the Service.

The User expressly agrees that Vextech is not, and under no circumstances may be, liable for violations of labor laws and other relevant regulations committed by Candidates and/or Employers.

Vextech holds exclusive copyright and intellectual property rights in the Service, as well as in all individual elements comprising the Service.

In accordance with the Terms of Use, Vextech grants the User a limited, non-exclusive, revocable, non-transferable right to use the services through access to and use of the Service on the User's device.

The User retains all copyright and related rights in content of which the User is the author. The User warrants that they are the holder or authorized user of all necessary copyright and related rights in respect of the entire content that the User posts on the Service.

Vextech's operations through the Service are governed primarily by:

• the Electronic Commerce Act,
• the Law on Obligations,
• the Advertising Act,
• the Copyright and Related Rights Act,
• the Trademarks Act,
• the Personal Data Protection Act,

as well as other regulations of the legal system of the Republic of Serbia.

By accepting the Terms of Use, Users agree that all disputes arising between the User and Vextech during the use of or in connection with the Service shall be resolved amicably.

If an amicable resolution cannot be reached, all disputes shall be submitted to the competent court in Belgrade, Republic of Serbia.

Vextech has the right to unilaterally amend the Terms of Use. In the event of amendments, Vextech shall notify Users at least 7 (seven) days prior to the entry into force of such amendments.

If the User does not agree to the amendments by the time such amendments enter into force, access to and use of the Service shall be disabled.
